1. Accepting the Terms

By accessing this Unified Social Media's website, products, software, or services (referred to collectively as the “Service” in this document), you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

2 . Rules Regarding Member Web Site Operation and Interface with Unified Social Media Service

Web sites registered with any of Unified Social Media's services must conform with the rules outlined below. Web sites not conforming to the following rules will be removed and banned at the discretion of Unified Social Media.

2.1 Inclusion and display of the friend link sharing widget

  1. Only one account per person is allowed. You understand and expressly agree that you will not create more than one account.
  2. In the interest of fairness for all users, web sites must include the friend link sharing widget code on every page. Failure to do so may result in your account being suspended or deleted.
  3. Web sites may not attempt to obscure, hide, interfere with or in any way disrupt the operation of the Unified Social Media code and/or links placed on the website.

2.2 Appropriateness of links and content distributed through The Services

  1. All items in the web site's RSS feed must link to web pages located on the website for which the RSS feed has been registered. RSS links cannot direct viewers to third party websites.
  2. As the purpose of this service is to promote website content, all items in the web site's RSS feed must NOT link to any product page or web page whose purpose is to sell a good or service.
  3. Website content must be in English.
  4. All content and links distributed through the Service shall adhere to rules described in section 3
  5. You shall be solely responsible for your own Content and the consequences of submitting and publishing your Content on the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish Content you submit; and you license to Unified Social Media all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Service pursuant to these Terms and Conditions of Use.

2.3 Rights to distribute links and content

  1. You agree and acknowledge that you have the right to distribute the content being shared through your web site and RSS feed. The content of your RSS feed is displayed by Unified Social Media as part of the process of publicizing your content. You agree to allow Unified Social Media to display the content of your RSS feed on the Unified Social Media web site and to redistribute the content through a network of web sites.
  2. By providing Content (including through your registered RSS Feed) you hereby grant Unified Social Media a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Service and Unified Social Media's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels. The above licenses granted by you Content provided through your RSS feed terminate within a commercially reasonable time after you remove or delete your Content the Service. You understand and agree, however, that Unified Social Media may retain, but not display, distribute, or perform, server copies of your Content that have been removed or deleted.

2.4 Access to web site and RSS feed.

  1. From time to time Unified Social Media's servers may crawl your web site to validate the presence of required code and verify that the web site conforms to the Terms and Conditions of Use. In order to publicize your web site content, Unified Social Media will also use automated means to determine the content of your web site. You agree allow Unified Social Media to use automated means of examining your web site and you affirm that you have the legal right to give such permission.
  2. The automated analytical tools used by Unified Social Media may perform complex operations on the data retrieved from your web site and RSS feed in order to publicize your content effectively. Operations performed on your data may include redistribution, storage, transformation, concatenation, truncation, catigorization, and application of third party web services. You expressly understand and agree that Unified Social Media may conduct operations on your rss data included but not limitted to those listed above.
  3. You understand that the Service is supported by advertising revenue and may display advertisements and promotions. The manner and mode of advertising is subject to change with or without notice. You agree that Unified Social Media may place such advertising on the Service and that such advertising shall be displayed on your website. You further agree not to interfere with the display or proper functioning of such advertising in any way.

3. Prohibited Website Content

Web sites containing or linking to web sites that contain the following types of material are prohibited from usint the Service.

  1. Contain content that is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
  2. Harasses or advocates harassment of another person; exploits people in a sexual or violent manner;
  3. Contains nudity, violence, or offensive subject matter or contains a link to an adult website;
  4. Solicits personal information from anyone under 18;
  5. Promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
  6. Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
  7. Involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spimming," or "spamming";
  8. Furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
  9. Solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
  10. Involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
  11. Advertises to, or solicits any Member to buy or sell any products or services through the UnifiedSocialMedia.com Services. You may not transmit any chain letters or junk email to other Members. It is also a violation of these rules to use any information obtained from the UnifiedSocialMedia.com Services in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.

4. Limitation of Liability

IN NO EVENT WILL UNIFIED SOCIAL MEDIA BE LIABLE TO YOU FOR ANY LOST PROFITS, LOST SAVINGS OR INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF YOUR USE OR INABILITY TO USE THE SERVICE OR THE BREACH OF THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU

  1. The Service is provided "as is" and "as available". Unified Social Media makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. You expressly understand that use of the Service is at your sole risk.
  2. Further, Unified Social Media does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Service on its Internet web site or otherwise relating to the Service or on any sites linked to this site.
  3. No information obtained from Unified Social Media, whether oral or written shall create any warranty not expressly stated in the terms.
  4. While aim to employ semantic analysis of web pages, however, we expressly do not guarantee that any particular web page or web content will be analyzed. You expressly understand that your links may be placed randomly and not with any targeting of any kind.

6. Revisions and Errata

The materials appearing on Unified Social Media's web site could include technical, typographical, or photographic errors. Unified Social Media does not warrant that any of the materials on its web site are accurate, complete, or current.
